These are the terms and conditions for McKean Associates Ltd trading as McKean First-Aid.
McKean First-Aid reserves the right to make changes to its courses, including information relating to content, timings, date and venue.
1. Course fee and payment
1.1 The full course fee must be paid at the point of booking. Where a later payment is mutually agreed, a 50% deposit must be paid at the point of booking. All remaining fees must always be paid in full before the start of the course.
1.2 Learner registration and claiming of certificates cannot be made until full payment has been received.
1.3 McKean First-Aid has the right to refuse an attendee entry if the course fee or booking fee is not paid before the start date of the course.
1.4 Courses will be charged at the price quoted and agreed upon at the point of booking. We reserve the right to change course fees without notice.
2. Cancelled courses or sessions
2.1 McKean First-Aid has the right to cancel a course or session. In this instance we will offer a place on the same course within a 12 month period. If the same course is not available within a 12 month period, reimbursement will be made in full.
2.2 McKean First-Aid’s liability will be limited to the value of the course fees paid.
3. Cancellations
3.1 Cancellations must be made by email to info@mckeanfirstaid.co.uk.
3.2 If a cancellation is made 30 days before the start of the course, a full refund less an administration fee of £10 will be given.
3.3 If a cancellation is made between 15 and 29 days before the start of a course, 50% will be refunded, less an administration fee of £10.
3.4 If a cancellation is made between 1 and 14 days before the start of the course, no refund will be payable.
3.5 If a cancellation is made on the day of the course or once the course has started, no refund will be payable.
3.6 If a learner fails to attend the course then the fees will still apply and no refund will be given.
3.7 All learners are expected to behave in a respectful manner towards both their fellow peers and the trainer. The trainer has the right to ask learners to leave the course without a refund if their behaviour is deemed to be inappropriate.
3.8 Learners must adhere to all awarding bodies assessment protocols. Failure to do so may result in the learner being issued with an attendance certificate as opposed to a full certificate issued by the awarding body. No refund or discount will be made for learners who are issued an attendance certificate as opposed to a full certificate issued by the awarding body.
3.9 The trainer has the right to refuse entry to the course if learners are more than 10 minutes late.
4. Transfers & Change of Course dates
4.1 If an individual learner can no longer attend their course, they can nominate another person to attend in their place before the course starts. This is provided the person meets all specified entry requirements for the course and attends for that booked space. This will not incur any additional charge.
4.2 If a group booking requests a change to the course start date, this will incur a £20 rebooking fee if made up to 14 days before the start of the course.
4.3 If a group booking requests a change to the course start date less than 14 days before the start of the course, this will incur a £50 rebooking fee.
4.4 Requests to change course start dates must be made at least 24 hours before the course is due to start. Requests to rebook later than 24 hours prior to the course start date may incur a further £50 as penalty to cover trainer expenses and other pre-booked services, such as catering and refreshments.
4.5 The total cost for any venue hire on behalf of the group for the course, will be the responsibility of the person or organisation that booked the course. They will be required to make any payments in full as per the venue’s booking and cancellation policy. This will be deducted from the course fee paid when the course was initially booked and hence from any money refunded.
4.6 McKean First-Aid, will endeavour to rebook courses wherever possible within a 12 month period. Where this is not possible, or a suitable new date cannot be agreed upon, a full refund will be made, minus any deducted costs, for example admin fees or venue hire costs.
4.7 Where a new course date is agreed, any new or additional venue hire fees will be payable by the person or organisation booking the course on behalf of the group.
4.8 No refund will be payable for any request to change the booking date once the course has started.
5. Warranty and Liability
5.1 All learners accept that it is their responsibility to ensure that the course is suitable for them and that they have the necessary competence to achieve the objective of the course or session.
5.2 Although McKean First-Aid aims to provide services to the highest standards, neither it, nor its trainers accept any liability for (i) any loss or corruption of data, (ii) any loss of profit, revenue or goodwill, or (iii) any indirect, special or consequential loss arising from any breach of the terms of this agreement.
5.3 If a learner cannot access any online courses because they fail to meet the necessary system requirements, then McKean First-Aid will not take responsibility or give a refund. It is the learner’s responsibility to test their system for any compatibility issues prior to booking a course with online content.
6. Intellectual Property
6.1 The copyright and all other intellectual rights in all course materials shall remain the sole and exclusive property of the McKean First-Aid and/or relevant awarding bodies. Learners undertake that they will not copy, or permit to be copied, such course material nor disclose, or permit others to disclose, sell, licence or hire the same to third parties, nor use the same to run their own courses whether for internal use or external use.
6.2 Learners accept that it is their responsibility to ensure that the course is suitable for them and that they have the necessary competence to achieve the objective of the course or session.
7. Replacement Certificates
7.1 Replacement certificates can be requested by emailing info@mckeanfirstaid.co.uk. McKean First-Aid charges a £10 administration fee in addition to the cost imposed by the awarding body, of which the amount may vary depending on the course attended for replacement certificates.
8. Force Majeure
8.1 McKean First-Aid shall not be liable to you for any breach of its obligations or termination under these terms and conditions arising from causes beyond its reasonable control, including, but not limited to, fires, floods, earthquakes, volcanoes and other Acts of God, terrorism, strikes, delay caused by transport disputes, failure to provide a course caused by a death in the trainer’s family, illness of the trainer, Government edict or regulation.
9. Law
9.1 This Agreement and any other agreement of which it forms part shall be construed and enforced in accordance with the laws of England and the English Courts shall have exclusive jurisdiction.
